TERMS AND CONDITIONS OF GALACTIC SHRIMPS ONLINE STORE


§1 Definitions

  1. Business days – days from Monday to Friday, excluding statutory holidays.

  2. Consumer – a consumer within the meaning of the Civil Code.

  3. Privileged entrepreneur – a natural person conducting business activity who enters into an agreement with the Seller not directly related to their professional activity (Article 38a of the Consumer Rights Act).

  4. Buyer – any entity making purchases in the Store.

  5. Privileged buyer – a Consumer or Privileged entrepreneur.

  6. Account – a free electronic service, governed by these Terms and Conditions, enabling the Buyer to use additional store features.

  7. Newsletter – a free electronic service consisting of sending commercial information electronically.

  8. Auction – sale of aquarium shrimps in auction mode, organized on the Store website.

  9. Terms and Conditions – this document.

  10. Store – the online store operating at https://galacticshrimps.pl.

§3 Technical Requirements

To use the Store, you need a device with Internet access, a browser supporting JavaScript and cookies, and an active e-mail account.


§4 Shopping in the Store

  1. Prices listed in the Store are gross prices.

  2. The total price includes the price of the goods and delivery costs, indicated when placing the order.

  3. An order is placed by adding goods to the cart and completing the order form.

  4. Placing an order constitutes conclusion of a sales contract.

  5. Confirmation of the contract is sent on a durable medium no later than upon delivery of the goods.

  6. You can shop with an Account or without registration.


§5 Payments

  1. Available payment methods:

    • Stripe electronic payments.

  2. Some methods require payment immediately after placing the order.

  3. The Buyer accepts electronic invoices.


§6 Order Fulfillment

  1. The Seller delivers goods within Poland and Europe.

  2. The order fulfillment time is indicated in the Store.

  3. Goods are shipped by courier.


§7 Right of Withdrawal from the Contract

A Privileged buyer may withdraw from the contract within 14 days without giving a reason. The rules and effects of withdrawal from the contract are set out in the Consumer Rights Act and the attached form.


§8 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the case of:

  • goods that deteriorate quickly,

  • products prepared according to the Buyer’s specifications,

  • products in sealed packaging after opening, if they cannot be returned for hygiene reasons.


§9 Complaints

  1. The Buyer has the right to file a complaint based on warranty or guarantee.

  2. Complaints should be submitted to the Seller’s postal or e-mail address.

  3. The Seller processes complaints within 14 days.

  4. Consumers may use mediation, arbitration, or the ODR platform (https://ec.europa.eu/consumers/odr/).


§10 User Account

  1. Creating an Account is voluntary and free.

  2. The Account allows you to view order history, among other features.

  3. The Buyer may delete the Account at any time by sending an e-mail to the Seller.


§11 Newsletter

  1. The Newsletter service is free and voluntary.

  2. You can unsubscribe from the Newsletter at any time via the link in the message or by e-mail contact.

  3. Personal data is processed for the purpose of providing the Newsletter.


§12 Aquarium Shrimp Auctions

  1. Organizer – GS Global Trade Sp. z o.o.

  2. Participation conditions: legal age and account registration on the website.

  3. Auction process: the auction runs for a specified time, participants raise the price, the highest bid wins.

  4. Payments: the winner must pay within 24 hours; failure to pay results in account suspension and placement on the “Banned” list.

  5. Shipping: shrimps are shipped from Monday to Wednesday.

  6. DOA complaints are processed in accordance with §16.


§13 Personal Data

  1. The data controller is GS Global Trade Sp. z o.o.

  2. Data is processed in accordance with GDPR and the Privacy Policy.

  3. The Buyer has the right to: access, rectification, deletion, restriction of processing, data portability, and objection.


§14 Reservations

  1. Providing unlawful content is prohibited.

  2. Contracts are concluded in Polish.

  3. In matters not regulated, Polish law applies.


§15 Final Provisions

  1. The Seller may change the Terms and Conditions for important legal or organizational reasons.

  2. The Buyer will be informed of changes in advance.


§16 DOA (Dead On Arrival) Complaints

  1. DOA complaints apply only to shipments containing live animals (aquarium shrimps).

  2. DOA complaints are processed only for shipments sent via “Express Courier” service, ensuring delivery within 24 hours.

  3. The Buyer is required to report a DOA complaint no later than 2 hours after receiving the shipment, by sending an e-mail to: info@galacticshrimps.pl.

  4. The report must include:

    • order number,

    • photos or video of the package contents and transport bags (without opening them),

    • photo of the courier shipment label.

  5. DOA complaints will not be processed if:

    • the shipment was received after the guaranteed delivery time,

    • transport bags were opened before documentation was made,

    • the delay in delivery resulted from the Buyer’s fault (e.g., incorrect address, absence).

  6. After a positive complaint resolution, the Seller may offer:

    • re-shipment of live animals at the Seller’s expense.

  7. DOA complaints are processed within 7 business days from the date of receiving the complete report.
